South Dakota's First Execution In 59 Years Halted




PIERRE, S.D. -- South Dakota Gov. Mike Rounds halted the state's first execution in 59 years just hours before it was scheduled on Tuesday, saying the state law detailing how to administer lethal drugs is obsolete.

Elijah Page, 24, had asked to be put to death by lethal injection for the 2000 torture murder of a South Dakota man. It had been scheduled for 10 p.m.

The delay is in place until next July, giving lawmakers time to bring the law into line with most other states that use lethal injection.


Page and two other young men killed a man in the Black Hills so there would be no witness to the theft of a Chevy Blazer and items from the victim's home. The torture killing lasted at least two hours.

At one point Page and his family lived in Watertown, N.Y. A long time family friend said Michelle Page treated her son like he didn't exist.

Michelle Page has denied that Elijah was found wandering the streets naked and also denied reports that the kids watched her have sex with several men at the same time or that she let drug dealers molest Elijah in return for drugs

The studio behind the Oliver Stone drama "World Trade Center" makes good on a promise to donate 10 percent of its opening box office.

Paramount Pictures announced Tuesday that it will donate $2.6 million to four New York-based Sept. 11, 2001, charities -- roughly 10 percent of film's opening five-day gross.

The donations are meant to "honor the memory of those lost in the Sept. 11 attacks and provide ongoing help to their families," Paramount said.


As previously announced, $1.3 million is being donated to the World Trade Center Memorial Foundation. The funds will be used for the construction of the Memorial's two reflecting pools, which will be located on the footprints of the original Twin Towers.

The other $1.3 million will be shared equally among Tuesday's Children, the Tribute WTC Visitor Center and the New York Police and Fire Widows' and Children's Benefit Fund.

Each of the organizations will receive approximately $433,000.

Directed by Oliver Stone, "World Trade Center" tells the true story of real life Port Authority police Officers Will Jimeno (Michael Pena) and John McLoughlin (Nicolas Cage), who were rescued hours after being buried beneath the rubble of the World Trade Center.

The film earned $26.5 million its first five days of release. It has grossed more than $55 million at the box office thus far.

"World Trade Center" is the second Sept. 11, 2001-themed film to be released in theaters this year.

"United 93" -- a real-time docudrama that recounts the entire hijacked Sept. 11, 2001, flight that was taken back by passengers before it crashed in a field in Shanksville, Pa. -- was released in April.

The film's studio, Universal, initially donated 10 percent of its opening weekend gross -- $1 million -- to the Flight 93 Memorial, and an additional $250,000 in June.

NEW ORLEANS -- Exactly one year ago, Hurricane Katrina devastated much of the Gulf Coast and nearly drowned an American city
On Tuesday, residents will pause to remember the anniversary of the storm, which hit on Aug. 29, 2005. But not for long: There's still a lot of work to be done rebuilding.

"Everything look dead," said New Orleans resident Willis Wesley said of his city. "It was just like a nuclear war or something. ... There just aren't any structures anymore."

For many, the passage of a year doesn't make it any easier.

"It's just heartbreaking, because you've lived here so long and you can't get nothing out of the house," said New Orleans resident Jenelle Smith.

For thousands it is still impossible to come home. It will take years to rebuild what Katrina took away. "It takes so much effort to do so little," said Biloxi, Miss., resident Scott Barnett.

On a two-day tour of the region, President George W. Bush promised residents they would not walk the road to recovery alone.

"I've come back on this annivesary to thank you for your courage and to let you know the federal government stands with you still," Bush said.

But for many, doing it themselves has been the only way to get things done.

Warren Steed Jeffs found

CBS News) LAS VEGAS The fugitive leader of a polygamist breakaway Mormon sect has been arrested in southern Nevada, the FBI said Tuesday.

Warren Steed Jeffs, 50, was taken into custody after he and two other people were pulled over late Monday by a Nevada Highway Patrol trooper on Interstate 15 just north of Las Vegas, FBI spokesman David Staretz said.

The leader of the Fundamentalist Church of Jesus Christ of Latter-day Saints was wanted in Utah and Arizona on suspicion of sexual misconduct for allegedly arranging marriages between underage girls and older men.

Since May, Jeffs has been on the FBI's Ten Most Wanted list, with a $100,000 reward offered for information leading to his capture.

The other two people in the vehicle were identified as one of Warren Jeffs' wives, Naomi Jeffs, and a brother, Isaac Steve Jeffs, both 32, Staretz said. They were being interviewed by the FBI in Las Vegas but were not arrested.

Jeffs was in federal custody in Las Vegas pending a court hearing on a federal charge of unlawful flight to avoid prosecution, Staretz said. It was not immediately clear if Jeffs would face extradition to Arizona or Utah.

Jeffs was indicted in June on an Arizona charge of arranging a marriage between a 16-year-old girl and a married man, and unlawful flight to avoid prosecution. He is charged in Utah with two felony counts of rape as an accomplice, for allegedly arranging the marriage of a teenage girl to an older man in Nevada.

The FLDS Church split from the Church of Jesus Christ of Latter-day Saints when the mainstream Mormon Church disavowed plural marriage more than 100 years ago.
